01 Acceptance of Terms
These Terms of Service ("Terms") govern the relationship between Link Building Austria ("we", "us", "our") and any individual or business ("Client", "you") that accesses our website or uses our services.
By submitting an enquiry, signing a service proposal, or making a payment, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy.
These Terms are governed by Austrian law and comply with the Austrian Consumer Protection Act (KSchG) and applicable EU regulations where relevant.
02 Services
2.1 Scope of Services
Link Building Austria provides professional link building services for the DACH region (Austria, Germany, Switzerland), including but not limited to:
- Guest post placements on third-party websites
- Niche edit / link insertion campaigns
- Editorial link placements on news and industry sites
- Brand mention campaigns
- Backlink audits and strategy consulting
2.2 Service Agreement
The specific deliverables, timelines, pricing, and scope for each engagement are defined in a separate written proposal or service agreement ("Agreement") provided to the Client. In the event of any conflict between these Terms and an Agreement, the Agreement shall prevail.
2.3 Subcontractors
We may use vetted subcontractors and third-party publishers to fulfil parts of our services. We remain responsible for the quality and delivery of agreed deliverables.
03 Client Obligations
To enable us to provide our services effectively, you agree to:
- Provide accurate and complete information about your website, business, and goals.
- Grant us access to necessary tools (e.g., Google Search Console, analytics) where agreed.
- Review and approve content or strategies within the timeframes specified in the Agreement.
- Ensure that your website complies with applicable laws and does not contain content that is illegal, defamatory, or harmful.
- Promptly notify us of any significant changes to your website, brand, or target keywords that may affect the campaign.
We are not responsible for delays or underperformance caused by your failure to fulfil these obligations.
04 Fees & Payment
4.1 Pricing
Fees are as set out in the applicable Agreement or proposal. All prices are exclusive of VAT (Mehrwertsteuer) unless stated otherwise. Austrian VAT at the applicable rate will be added to invoices for Austrian clients and where required by law.
4.2 Payment Terms
Invoices are due within 14 days of the invoice date unless otherwise agreed in writing. Payment must be made by the method specified on the invoice (bank transfer, card, or another agreed method).
4.3 Late Payment
Late payments accrue interest at the statutory rate under Austrian law (§ 1000 ABGB and the Zahlungsverzugsgesetz). We reserve the right to suspend services for accounts overdue by more than 14 days.
4.4 Refunds
Due to the nature of link building (publisher costs, content creation, outreach), payments for completed work are non-refundable. If we are unable to deliver agreed links within the specified timeframe through no fault of the Client, we will offer replacement links of equivalent or greater value or a proportionate credit.
05 Intellectual Property
5.1 Content We Create
All content created by Link Building Austria (including articles, copy, and reports) for the purpose of link placements becomes the property of the Client upon full payment, unless otherwise agreed. The Client grants us a licence to use their brand assets, content, and website information solely for the purpose of delivering the agreed services.
5.2 Our Website & Materials
All content on linkbuildingaustria.com — including text, graphics, logos, and design — is the intellectual property of Link Building Austria and is protected under Austrian and EU copyright law. You may not reproduce, distribute, or create derivative works without our prior written consent.
06 Confidentiality
Both parties agree to keep confidential all non-public information received from the other party in connection with the services, including pricing, strategies, publisher lists, and business data. This obligation survives termination of the Agreement for a period of 3 years.
Confidentiality does not apply to information that: (a) is or becomes publicly known through no breach of this clause; (b) was already known to the receiving party; or (c) must be disclosed by law.
07 Results & No-Guarantee Disclaimer
Link building is one factor among many in search engine optimisation. While we apply best-practice, white-hat methodologies and have a strong track record, we cannot guarantee:
- Specific rankings, traffic increases, or revenue outcomes.
- Permanent placement of links on third-party publisher websites (publishers occasionally remove or alter content at their discretion).
- Specific domain rating (DR) or domain authority (DA) metrics, as these are calculated by third-party tools and may fluctuate.
If a placed link is removed within 12 months of delivery through no fault of the Client, we will replace it free of charge, subject to availability.
08 Limitation of Liability
To the maximum extent permitted by Austrian law:
- Our total liability to you for any claim arising from these Terms or the services shall not exceed the total fees paid by you in the 3 months preceding the claim.
- We are not liable for indirect, consequential, special, or punitive damages, including loss of profit, loss of revenue, or loss of data.
- We are not liable for actions taken by third-party publishers, platforms, or search engines.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Austrian law.
09 Indemnification
You agree to indemnify, defend, and hold harmless Link Building Austria, its directors, employees, and contractors from and against any claims, liabilities, damages, and costs (including reasonable legal fees) arising from:
- Your breach of these Terms.
- Your violation of any applicable law or third-party rights.
- Content or materials you provide to us that infringe third-party intellectual property rights or contain illegal content.
10 Term & Termination
10.1 Term
These Terms apply from the date you first use our website or engage our services and continue until terminated.
10.2 Termination by Client
You may terminate an ongoing service engagement with 30 days' written notice. You remain liable for all fees for work completed or in progress at the time of notice.
10.3 Termination by Us
We may suspend or terminate services immediately if: (a) you breach these Terms and fail to remedy the breach within 7 days of written notice; (b) you fail to pay invoices; or (c) continuing the engagement would require us to act in an unlawful manner.
10.4 Effect of Termination
On termination: all outstanding fees become immediately due; we will deliver any completed work; clauses relating to confidentiality, intellectual property, limitation of liability, and governing law survive termination.
11 Website Use
You agree to use linkbuildingaustria.com only for lawful purposes. You must not:
- Use the website in any way that violates applicable local, national, or international laws.
- Transmit unsolicited commercial communications (spam).
- Attempt to gain unauthorised access to our systems or data.
- Use automated tools to scrape, copy, or extract content from our website.
We reserve the right to restrict or terminate access to the website for any user who violates these rules.
12 Third-Party Links
Our website may contain links to third-party websites for informational purposes. These links do not constitute an endorsement. We have no control over the content, privacy practices, or reliability of third-party sites and accept no responsibility for them. Accessing third-party websites is at your own risk.
13 Governing Law & Dispute Resolution
These Terms and any disputes arising from them are governed by the laws of Austria, specifically the Austrian Civil Code (ABGB) and Commercial Code (UGB), without regard to conflict of law principles.
The courts of Vienna, Austria shall have exclusive jurisdiction over any disputes, except where mandatory consumer protection laws of the Client's country of residence provide otherwise.
Before initiating legal proceedings, both parties agree to attempt to resolve disputes in good faith through direct negotiation for a period of 30 days.
For EU consumer disputes, the European Commission's Online Dispute Resolution platform is available at: ec.europa.eu/consumers/odr. However, as our services are directed at business clients, ODR may not apply.
14 Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will update the "Last updated" date at the top of this page. For existing Clients with active Agreements, material changes will be communicated by email with at least 14 days' notice before taking effect. Continued use of our services after the effective date constitutes acceptance of the updated Terms.
